These General Terms and Conditions of Sale apply whether the order is placed on the website www.bonheurdujourparis.com or by telephone.
Consequently, any person ordering a product offered for sale on the website www.bonheurdujourparis.com fully and unreservedly accepts these General Terms and Conditions of Sale, which the Customer acknowledges having read prior to placing the order.
Should any provision be missing, it shall be deemed to be governed by the practices in force in the distance-selling sector for companies whose registered offices are located in France. The Customer further declares that he or she has full legal capacity to enter into obligations under these General Terms and Conditions of Sale.
ARTICLE 1. PURPOSE
The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the parties in connection with the online sale of goods and services offered by BONHEUR DU JOUR to the Customer, from ordering through payment and delivery, as well as the use of any other service made available by BONHEUR DU JOUR. These General Terms and Conditions of Sale are available at all times on the website www.bonheurdujourparis.com. BONHEUR DU JOUR reserves the right to amend these General Terms and Conditions of Sale at any time. Nevertheless, the General Terms and Conditions of Sale applicable to an order placed by a Customer are those accepted by the Customer at the time the order is placed.
ARTICLE 2. ORDER
The ordering process on www.bonheurdujourparis.com is as follows:
- Selection of items and addition to the shopping cart.
- Validation of the contents of the shopping cart.
- Identification on the website www.bonheurdujourparis.com if the Customer is not already logged in.
- Provision of the information required for delivery (precise delivery address and any accessibility restrictions at the delivery location).
- Selection of the delivery method and acceptance of the General Terms and Conditions of Sale.
- Selection of the payment method.
- Validation of payment.
During these different stages, the Customer will be able to view the details of the order and its total price. The Customer will also be able to correct any errors and check the order before confirming it.
Order validation:
Any order constitutes acceptance of the prices and descriptions of the items available for sale. By confirming the order and ticking the box “I accept the General Terms and Conditions of Sale.”, the Customer irrevocably accepts these General Terms and Conditions of Sale in their entirety. By doing so, the Customer acknowledges having read, understood and accepted these terms and conditions.
Order confirmation:
Once the order has been validated, an email is automatically sent to the Customer to confirm the order, provided that the email address entered in the registration form does not contain an error.
Order tracking:
The Customer can track the status of the order by consulting the “My Account” section on the website www.bonheurdujourparis.com.
Conclusion of the sales contract:
By making payment, the Customer formally and definitively enters into the sales contract binding the Customer to BONHEUR DU JOUR.
BONHEUR DU JOUR reserves the right to cancel or refuse an order in the event of a previous dispute with the Customer or in the event of total or partial non-payment. BONHEUR DU JOUR also reserves the right to request any document or supporting evidence it considers useful and to cancel any order or delivery if such verification is unsatisfactory. It may not be held liable in the event of fraud or misconduct that has not been detected.
ARTICLE 3. PRODUCTS
Product characteristics:
BONHEUR DU JOUR will make every effort to ensure that the photographic representation of the products on the website www.bonheurdujourparis.com is as faithful as possible. Nevertheless, the perception of the product(s) through photographs may not correspond exactly to the products, and slight differences in colour may notably occur. Likewise, embroidery on BONHEUR DU JOUR designs may show irregularities because it is partly handmade. This handcrafted character is intentional and makes each design unique.
Product availability:
BONHEUR DU JOUR undertakes to fulfil orders received on the website www.bonheurdujourparis.com subject to available stock. If one or more ordered items are unavailable, BONHEUR DU JOUR undertakes to inform the Customer as soon as possible and will offer similar items. If none of these items is suitable for the Customer, BONHEUR DU JOUR undertakes to refund the Customer no later than 30 days following payment of the sums paid, using the payment method used by the Customer when placing the order. The Customer's order will then be automatically cancelled without any cancellation compensation (other than the full refund of the order).
ARTICLE 4. PRICES
The prices displayed are in EUROS including VAT and include French VAT. They do not include delivery costs or any other applicable taxes (customs duties, foreign VAT, etc.), which must be paid by the Customer. The contribution to shipping costs is indicated before the order is validated and accepted by the Customer.
The prices shown on the website www.bonheurdujourparis.com may be updated. These prices in EUROS including VAT take into account the VAT applicable on the date of the order; any change in the rate may be reflected in the price of the products. However, the price shown on the website on the date of the order will be the only price applicable to the Customer.
Orders destined for countries outside the European Union are not subject to French VAT. The prices shown on the website for these orders are exclusive of tax and do not include VAT. These orders may nevertheless be subject to taxes and customs duties in the destination country, which shall be borne by the Customer.
ARTICLE 5. PAYMENT
Payment in full must be made by the Customer when placing the online order. The Customer guarantees that he or she has the necessary authorisations to use the payment method selected when validating the order.
BONHEUR DU JOUR retains full ownership of the products sold until full payment of the total price has been received, including the principal amount, costs, taxes and mandatory contributions.
BONHEUR DU JOUR reserves the right to refuse to make a delivery or fulfil an order from a Customer who has failed to pay all or part of a previous order, or with whom a payment dispute remains outstanding.
Payment method:
Purchases may be paid for using the Customer's choice of:
- Bank card: Carte Bleue, Visa, Eurocard-Mastercard.
- PayPal.
- Bank transfer.
BONHEUR DU JOUR implements all necessary measures to ensure the security and confidentiality of data transmitted online. Accordingly, the website www.bonheurdujourparis.com uses SSL (Secure Socket Layer) secure payment technology, which encrypts the Customer's bank details when they are transmitted over the network. Transmission is encrypted by software when the padlock symbol appears in the browser. Bank card transactions are carried out via Crédit du Nord bank, which alone has access to the banking information provided on the website at the time of payment.
In order to ensure that no person fraudulently uses another person's bank details, BONHEUR DU JOUR reserves the right to ask the Customer to send by email to hello@bdjparis.com a copy of an identity document and proof of address. The order will only be validated after the documents sent have been received and checked. If the requested documents are not received within 15 days of the order being placed, the order will automatically be deemed cancelled.
Invoice:
The invoice is attached to the order confirmation email.
It is also available in the Customer's online account.
BONHEUR DU JOUR retains an electronic copy of each invoice for 10 years.
ARTICLE 6. DELIVERY
Products are delivered to the address provided by the Customer when placing the order. BONHEUR DU JOUR reminds the Customer that he or she is responsible for ensuring the accuracy of the information provided regarding delivery of the order and for ensuring that no useful information has been omitted. Failure to comply with this obligation will result in no claim from the Customer being accepted, and all costs incurred in reshipping the products will be borne entirely by the Customer.
Delivery areas:
BONHEUR DU JOUR delivers throughout France and the rest of the world, except to P.O. boxes.
For deliveries outside the countries of the European Union, any taxes and customs duties in the destination country must be paid directly to the carrier by the recipient.
Dispatch time:
Parcels are prepared and dispatched no later than 2 working days after payment for the order has been received. An email is automatically sent to the Customer when the products are dispatched, provided that the email address supplied does not contain an error. Upon receipt of the dispatch confirmation email, the Customer may take into account the delivery times indicated below.
Packaging:
Items are packaged in accordance with applicable transport standards and to ensure optimum protection during delivery. BONHEUR DU JOUR asks the Customer to comply with these same standards when returning products. In the event of a return, if BONHEUR DU JOUR finds that the items have been damaged due to failure to comply with these standards, BONHEUR DU JOUR reserves the right to issue only a partial refund for the product or to refuse a refund if the product cannot be resold.
Delivery method, time and costs:
The Customer may collect the order by appointment from the BONHEUR DU JOUR Showroom at 250 bis/2B rue du Flocon, 59200 Tourcoing – Tel.: +33 3.20.70.49.02.
Otherwise, delivery is carried out by COLISSIMO.
- Metropolitan France, Andorra, Monaco:
The usual delivery time is 48 hours from dispatch (excluding order processing and preparation time).
- French overseas departments and territories, European Union and Switzerland:
Usual delivery times vary between 3 and 7 days depending on the destination country, from dispatch (excluding order processing and preparation time).
- Worldwide:
Regardless of the order amount, delivery costs will be calculated upon request for a quotation at hello@bdjparis.com.
All delivery times are indicative only; exceeding them shall not entitle the buyer to cancel the order, obtain a reduction in the price paid or receive any payment by way of damages.
Parcel tracking:
The Customer can track the parcel on the carrier's website using the tracking number communicated by email when the order is dispatched.
Absence when the carrier calls:
If the recipient is absent at the time of delivery, the parcel will be delivered to the post office indicated on the delivery notice left in the recipient's letterbox. The parcel will be held at the postal collection point for a period of 15 calendar days from the day following the date on which the delivery notice was left. At the end of this period, the parcel will be returned to BONHEUR DU JOUR.
If the delay is attributable to the Customer, following an error in the delivery address or because the Customer did not collect the parcel within the allotted time, the cost of reshipping the parcel will be borne by the Customer.
Receipt of the parcel:
Upon receipt of the parcel, if the recipient considers that the packaging shows signs of damage, he or she may either refuse the parcel, in which case it will be returned directly to the sender, or request that it be held at the post office so that it can be opened in the presence of an authorised employee. If the parcel has been accepted by a third party, BONHEUR DU JOUR invites the Customer to complete La Poste's contact form.
Delayed or lost parcel:
The carrier undertakes to comply with delivery times and is therefore solely responsible for observing them. If these deadlines are not met, the Customer should first contact the carrier concerned to check that the ordered products are not being held pending delivery. In the event of a delay or difficulty locating the ordered products, the Customer may contact BONHEUR DU JOUR at hello@bdjparis.com. An investigation will then be carried out in an attempt to locate the parcel.
If the parcel is found, it will immediately be forwarded to the Customer's home. Otherwise, BONHEUR DU JOUR is dependent on the deadlines imposed by the carrier for declaring the parcel lost and reimbursing the shipment. No refund may therefore be made to the Customer before the carrier has declared the ordered products lost following its investigation. As soon as the carrier has issued the declaration of loss, BONHEUR DU JOUR will resend the goods at its own expense, subject to product availability, or refund the amount of the products concerned.
Products are delivered to the address provided by the Customer when the order is registered. The Customer must check the completeness and accuracy of the information provided to BONHEUR DU JOUR. BONHEUR DU JOUR cannot be held responsible for any data-entry errors or their consequences in terms of delays or delivery errors. In this context, all costs incurred in reshipping the order will be borne entirely by the Customer.
BONHEUR DU JOUR cannot be held responsible for delivery delays caused by errors or disruptions attributable to carriers (including, in particular, total or partial strikes affecting postal services and means of transport and/or communications).
Defective item:
BONHEUR DU JOUR pays the utmost attention to the quality of its products. However, if despite all quality checks carried out the Customer finds a defect, BONHEUR DU JOUR invites the Customer to report it by email to hello@bdjparis.com.
If a defect attributable to BONHEUR DU JOUR is confirmed, the Customer will have the option of exchanging the item (subject to available stock) or obtaining a refund. Upon receipt of a non-compliant item, BONHEUR DU JOUR will reimburse the return postage costs upon presentation of proof of payment of the shipping costs.
ARTICLE 7. RIGHT OF WITHDRAWAL, RETURNS AND EXCHANGES
In accordance with legal provisions (Article L 121-20 of the French Consumer Code), the Customer has a period of fourteen working days from receipt of the goods to notify us of the intention to return the product. Any request made after this period will not be taken into account. The Customer must return the goods at his or her own expense. The right of withdrawal may also be exercised from the time the order is placed and before delivery. If exercised after the product has already been dispatched, the return costs will remain the Customer's responsibility. BONHEUR DU JOUR will refund the Customer no later than 14 days following the date of withdrawal. Before returning the product, the Customer exercising the right of withdrawal must inform BONHEUR DU JOUR by email at hello@bdjparis.com.
The Customer will receive by email a return authorisation number to be indicated on the parcel, together with the address to which the returned items must be sent.
Any product from the website may be returned if it meets the following conditions:
- The returned product must be intact, in perfect resale condition, in its original packaging and bearing its label. It must not have been worn or used, must not have suffered even the slightest damage, and must be perfectly clean.
- The product must be returned in its entirety: if the Customer wishes to return a set, all components of the set must be returned.
- Returned products must be sent back within fourteen days of the date on which the Customer received them.
- Returned products must be sent to BONHEUR DU JOUR in a single shipment. BONHEUR DU JOUR reserves the right not to accept items from the same order that are returned and dispatched at different times.
- If the returned items do not comply with the conditions stated above, no refund may be issued; the items will be returned to the Customer at the Customer's own expense and risk.
Upon receipt and validation of the returned parcel, the Customer will receive confirmation by email. BONHEUR DU JOUR will then proceed with the exchange or refund.
Refund:
Return costs are borne by the Customer. In addition to the sums received for the purchase of the products, BONHEUR DU JOUR will reimburse the Customer for the shipping costs (upon presentation of supporting documentation) incurred for delivery of the purchased products only if the return is due to a reason attributable to BONHEUR DU JOUR, for example if the products do not have the essential characteristics promised, have manufacturing defects, or if errors were made in their delivery.
All returns must be sent by registered mail with acknowledgement of receipt; otherwise, any loss of the products during return transport cannot be taken into account.
Parcels containing no document enabling the Customer to be identified (order number, name, etc.) cannot be refunded or exchanged.
Please note: in the event of a return for an order delivered outside France, BONHEUR DU JOUR will refund the price of the items, excluding customs duties or any charges imposed on the Customer upon importation of the order.
ARTICLE 8. WARRANTIES AND LIABILITY
The products offered by BONHEUR DU JOUR comply with current French legislation and the standards applicable in France. BONHEUR DU JOUR cannot be held liable for failure to comply with the legislation of the country in which the product is delivered. The Customer is responsible for checking with the local authorities the possibilities for importing or using the products he or she intends to order.
BONHEUR DU JOUR cannot be held liable for any damage inherent in the use of the Internet, such as interruption of service, external intrusion or the presence of computer viruses, and more generally for any event classified as force majeure or an act of a third party by the courts.
